De rechtbank heeft een man uit Schagen veroordeeld tot tien maanden cel omdat hij zijn geslachtsdeel in de mond van een bewusteloze vrouw stopte. De vrouw overleed twee dagen later, maar de rechtbank acht niet bewezen dat zij gestikt is door de penis van de man.
De toen 31-jarige man uit Schagen belde in augustus 2022 in paniek het alarmnummer omdat de vrouw was gestopt met ademhalen. De 21-jarige vrouw werd naar het ziekenhuis gebracht, waar haar familie twee dagen later besloot de beademing stop te zetten.
Volgens de eerste verklaring van de man was de vrouw gestopt met ademhalen toen ze hem oraal bevredigde. Ook zou ze blauw zijn aangelopen. Tijdens de eerste strafzitting twee weken geleden zei hij dat ze onwel was geworden door de alcohol.
Het Openbaar Ministerie (OM) voerde aan dat de vrouw in de penis van de man is gestikt, maar dat acht de rechtbank niet bewezen. Volgens de rechtbank kan haar dood ook door alcoholvergiftiging zijn veroorzaakt. Wel staat vast dat de man zich schuldig heeft gemaakt aan het seksueel binnendringen van een persoon die daar geen bezwaar tegen kon maken.
Omdat niet vaststaat dat de orale seks tot haar dood heeft geleid, sprak de rechtbank de verdachte op dit onderdeel vrij. Daardoor viel de straf twintig maanden lager uit dan de door het OM geëiste 2,5 jaar. De rechtbank had eigenlijk een jaar cel willen opleggen. Omdat de berechting van de verdachte buiten zijn schuld lang op zich heeft laten wachten, is de straf twee maanden lager uitgevallen.
De politie trof op de telefoon van de man beelden aan van een chaotische avond met veel drank. De man zelf omschreef het als een “erotische avond” en deelde de video’s met bekenden.
Op de beelden is onder meer te zien dat de vrouw in verminderd bewustzijn op de bank ligt. De verdachte zegt op de filmpjes dat ze “buiten westen” is en spreekt in grove taal over orale seks. De rechtbank noemde het gedrag van de man respectloos.
Het slachtoffer en de man woonden samen, maar zouden geen relatie hebben gehad. Wel hadden ze regelmatig seks. De officier van justitie omschreef de vrouw als een “jong, kwetsbaar meisje” dat allebei haar ouders had verloren. Volgens de verdachte had hij tegen familieleden gezegd dat hij “het beste” voor de vrouw kon zorgen.
Volgens de rechtbank heeft de man “de weerloze en kwetsbare positie van het slachtoffer misbruikt voor zijn eigen lustbevrediging”. De rechter wees er daarbij op dat de jonge vrouw min of meer van hem afhankelijk was en eerder slachtoffer was geweest van seksueel misbruik.

According to the court, her death may also have been caused by alcohol poisoning. It is established that the man is guilty of the sexual penetration of a person who could not object to it.
Because it is not certain that the oral sex led to her death, the court acquitted the suspect on this part. As a result, the sentence was twenty months lower than the 2.5 years demanded by the Public Prosecution Service. The court actually wanted to impose a one-year prison sentence. Because the suspect’s trial was delayed for a long time through no fault of his own, the sentence was two months lower.
The police found images on the man’s phone of a chaotic evening with a lot of alcohol. The man himself described it as an “erotic evening” and shared the videos with acquaintances.
The images show, among other things, that the woman is lying on the couch in a reduced state of consciousness. The suspect says in the videos that she is “passed out” and speaks in crude language about oral sex. The court called the man’s behavior disrespectful.
The victim and the man lived together, but were not said to have had a relationship. They did have regular sex. The public prosecutor described the woman as a “young, vulnerable girl” who had lost both her parents. According to the suspect, he had told family members that he could take “the best” care of the woman.
According to the court, the man “abused the defenseless and vulnerable position of the victim for his own gratification”. The judge pointed out that the young woman was more or less dependent on him and had previously been a victim of sexual abuse.
