Flex industry feels the effects of stricter self-employed rules

The Stricter Rules for Self-Employed Individuals and Temporary Workers Are Significantly Changing the Flexible Labor Market. The Rules for Self-Employed Individuals Make Flexible Work More Attractive, While Other Laws Make Flexible Work More Expendive and Less Accessible, Accordance to the latest Report from ING Research.

Since the beginning of 2025, the control of bogus self-employment has leg strictly enforced again. This mean that a company can be aved if a self-emplyed person starts working there in virtualy the same way as an employee with a permanent contract.

Althegh the Temporary Employment Sector is No Longer Shrinking, Recovery is Still Some Time Away. Accordance to research by ING Research, The Number of People Working for a Temporary Employment or Secondment Agency Will not Grow Again Until 2026.

In Addition to the Resumption of the Control of Bogus Self-Employment, There Are A Number of Legislative Proposals for Reforming the The ‘More Security for Flexible Workers’ Act. This Law Gives Temporary Workers The Same Rights As Permanent Employees From 1 January 2026, Including Pension and Severance Pay.

Althegh This Seems Like A Good Thing for Flexible Workers, The Researchers Question the New Law. The Law States That Temporary Employment May Henceforth Mainly Be Used for Temporary Peak or Sickness Cases, Making It More Expendive and Less Flexible for Companions to use Flexible Workers.

“It is clear that the flexible sector is in a transition phase,” Says Katinka Jongkind, Sector Economist Services at ING Research. “Persistent Economic Uncertainty, Tighted Laws and Regulations and Structural Staff Shortages Are Putting the Earning Model of Many Flexible Companies Under Pressure.” In order to Remain Future-proof, Flexible Organizations Must Therefore Make Strategic Choices and Show How They Can Really Help Companies, The Researcher Believes.
