An American Court of Appeal has again declared the import duties of President Donald Trump in force. It seemed that it was going to happen after the government had appealed against the command of a commercial court to block the taxes.
A three -person commercial court ruled in the night from Wednesday to Thursday (Dutch time) that the import duties that Trump has introduced are unconstitutional. It is not up to the president to introduce such charges, the court ruled, that is only allowed by the American congress.
The court ordered that the import duties had to be blocked immediately. But by the decision of the Court of Appeal, that blockade is now suspended, as long as the appeal is running.
Trumps government had immediately appealed after the commercial court ruling. The government believes that it is not the court to interfere with the president’s choices. The national lawyer spoke in a reaction of a “judicial coup” that “got completely out of hand”.
Until a higher court and then possibly the American Supreme Court rules, the import duties will continue to apply. The consequences are also unclear for afterwards. If higher judges conclude the same as the commercial court, Trump must reverse his import duties. But in recent months the US president has often called back by judges without listening to it.
High import duties led to Trade War
Since his self -made ‘Liberation Day’, Trump has introduced dozens of percentage of import duties for products from countries around the world at the beginning of April. His idea is that it boosts the domestic economy.
The introduction of these extra taxes caused a trade war and bouncing stock prices, because some of the countries reduced by themselves also introducing taxes for products from the US. Later, Trump decided to postpone or lower his trade rates for products from many countries (and also the European Union).
