Supreme Court: Minister must decide on delivery F-35 parts to Israel

The Supreme Court Has Ruled That The Caretaker Cabinet Must Re-Examine Whether to Supply Parts for F-35 Fighter Jets to Israel. In Doing So, The Court Does Not Endorse An Earlier Ruling by The Court of Appeal.

The Court of Appeal had imposed a ban in February. It found that there was a clear risk that Israel would use these aircraft for serious violations of humanitarian law in the gaza strip.

The Cabinet Appealed in Cassation to the Supreme Court. Altheghie there was advice to uphold the ban, the supreme court decided not to agree with it.

Accordance to the supreme court, it is not up to the Judge to Assess this. The Highest Court Now Instructs Outgoing Minister David Van Weel To Review The Arms Export Policy Within Six Weeks. This mean that of Weel Must decide Whether or not to issue a new permit for the export of F-35 Parts to Israel.

In The Assessment, The Minister Must himself Assess Whether there is a Risk of Violations of International Humanitarian Law.
