What is it anyway?

The special location for nuisance asylum seekers is called a process availability location (PBL). For the time being, it is a test to see if such a special location can reduce nuisance.

Asylum seekers can be taken care of in the PBL in Ter Apel from Sunday who have little chance of an asylum permit (because they come from a safe country, for example) and cause nuisance.

Not all of these people immediately come to the PBL. The PBL is part of a step -by -step plan. Only when a nuisance maker does not comply with previously imposed conditions or causes serious nuisance, does the PBL come into view.

Why is the PBL needed?

In Hoogeveen there is already a special reception location for asylum seekers who have voted a lot. But the municipality of Westerwolde and politics wanted to have a place on the asylum seekers’ center (AZC) in Ter Apel for the people who do cause nuisance, but not to the extent that they could be sent to Hoogeveen.

Ter Apel experiences a lot of nuisance from a small group of asylum seekers. This happens not only at the AZC itself, but also in the village.

The nuisance is often caused by people who have little chance of a residence permit. It is also intended that they go through the asylum procedure faster with this approach.

Why did the judge pass a line through the approach?

The previous cabinet already started in the summer of 2023 with a similar test in Ter Apel, who was also named PBL. It was a slightly different approach than the PBL NOW. The goal was the same: put nuisance asylum seekers in a special place and guide the asylum process extra quickly.

But the judge took a line in 2024. The government had to have a good reason to put someone in that ‘old’ PBL, and that was not put on paper well enough. At that time, someone had to stay in the PBL 22 hours a day. That restriction of freedom was too great, the judge said.

That is why the plan went back to the drawing table. The cabinet at the time came with a new approach. The nuisance provider had to register twice a day in the PBL and follow a day program.

To be able to open that PBL again, it had to be quiet enough in Ter Apel. After all, the registration center was far too full for a long time. There was no room for a PBL until this year.

Why can the PBL open again?

The wish remained to open the PBL again. In the meantime it is also a lot quieter in Ter Apel and the PBL can open again.

The difference with the old approach is that asylum seekers no longer have to be in one place 22 hours a day, but be able to move freely within those indicated areas. Also, someone who causes nuisance is not just put in a PBL, which could be the case in the past. Now there is a “sliding scale” via the step -by -step plan that asylum minister Marjolein Faber presented in Ter Apel earlier this year.

In the first instance, there are eighty places in Ter Apel available for asylum seekers who are somewhere in that step -by -step plan. Five places are specifically reserved for the PBL. That should ultimately be more.

Incidentally, that step -by -step plan stated that the PBL would not be used immediately, because the government still had to investigate how that was allowed. But, the House of Representatives told Faber, the ‘new’ PBL would just be legally allowed. The minister later came to that, and so the reopening date of 1 June appeared in the agenda.

Will this help?

The question was whether the PBL can really be opened on 1 June. At the beginning of May, sources told de Volkskrant that this seemed unlikely.
