Nirvana Has Once Again won A Lawsuit Regarding the Cover of the Album Nevermind , Reports Billboard . Spencer Elden, the man who appeared as a four-month-old baby naked on the album cover, had Filed A Lawsuit. He claimed that the photo is child pornography.

In The Ruling, The Judge Writes That The Photo is More Reminiscent of “A Family Photo Of A Naked Bathing Child” and Does Not Fall Under Child Pornography. “Neither the pose, nor the setting, nor the overall context indicate sexual explicit conduct on the cover.”

The Judge also Questioned Why the Now 34-Year-Old Elden had PreviOutly had no problem with the album cover. “He has finarely benefited from it for years. His Actions Regarding the album are Difficult to Reconcile with his Claim that the album cover is child pornography and that has suffered serious damage as a result,” the Judge Said.

An Attorney for Nirvana Responded in a Statement to Billboard with Satisfaction. “We are pleased that the court is put an end to this case and has freed our clients from the stigma of false accusations.”

Elden Filed A Lawsuit in 2021. In 2022, The Judge Ruled that the man had Filed the Case Too Late. A HIGHER COURT OPTURNED That Decision A Year Later, Allowing the Case to Be Heard After All.
