The municipality of Veenendaal has acted unlawfully with an investigation into the foundation and mosque Taubah, the court judges. Several municipalities had the NTA NTA Muslim communities investigate. It is the first time that a court judges the legality of these investigations.
Veenendaal had the NTA company researched the organization and its community without the knowledge of Taubah. This violated the municipality of privacy rights. Veenendaal is liable for the damage that Taubah suffered by the investigation. What that damage is, according to a Taubah lawyer, is determined at a later time.
The municipality also shared the report with others without a rebuttal. E-mails show that it is in any case a number of ministries. NRC and Bureau Spotlight wrote earlier that the investigation into, among other things, the AIVD was sent.
The municipality did not deny this during the hearing earlier this year. Veenendaal must inform Taubah’s lawyers within thirty days with whom the report was shared exactly. Otherwise the municipality must pay 1,000 euros per day, with a maximum of 25,000 euros.
