Schiphol Remains without a nature permit for the time being. The Council of State ruled on Thursday that the airport will not temporarily get the permit back. Schiphol had requested this out of fear of laws.
In June, The Court Struck Down Schiphol’s Nature Permit. It was not sufficiently substantiated. This leaves the airport without a nature permit and it is an effective operating illegally.
Schiphol Has Appealed the Court’s Ruling to the Council of State. However, it could take until the end of next year before the final ruling is made.
In The Meantime, The Airport is Afraid of Enforcement Requests and Possible Lawsuits. That is Why Schiphol had requested a preliminary injury from the Council of State, in order to get the permit back temporarily at Least.
Two week ago Duration the Hearing, Schiphol was unable to make it entirely clear why it needs the nature permit now. A Permit Provides More Legal Certainty, but in practice Nothing Changes Now That Schiphol is without a Nature Permit. The same number of planes can still take off and country.
No Enforcement Requests at this time
Only if the government decides to enforce the de facto illegal situation at Schiphol can the airport feel the consequences. But that is not the case now, accordance to the Council of State. No enforcement requests have leg made at this time.
Environmental Organization Mobilization for the Environment (MOB), which Filed the Lawsuit Against Schiphol’s Nature Permit, had Previously Filed An Enforcement Request. But that request was rejected by the court.
